since we're talking about our gov't, i wanted to get this off my chest: yesterday i was introduced to a woman who lost her son in Iraq while he was serving in the Army. He's been dead about two years. He got a fancy military funeral. This mom lives in poverty now with her two daughters in Brooklyn. (Her daughter-in-law got all the death benefits.) She recently hurt her back, but cannot afford to go to a doctor. Her other son served three tours in the middle east as a Marine only to come back to ny and find he can't make more than $7.50 an hour here! So he enlisted with the army this time. So is it really an all volunteer army if kids are pushed and kept in via poverty? No wonder there are so many homeless vets.

The videos virtually disappeared once the measure became law, the government argued.

Why would anyone want to watch an animal being tortured? I just don't get it. I heard they just didn't want to change the wording to what was already written. But now all the weirdos will go and make videos. I hate laws. It is so obvious of what is right and wrong. I say leave the animals alone already. I wish I could save all animals from harm. There must be a way to change this around.

After having added a comment here yesterday, it occurred to me that while it certainly ought to be illegal for people to film animals or humans getting tortured in cases where the film is for sadistic entertainment purposes, documentation of cases on film of animals or people getting tortured if the purpose of the film is to expose the perpetrators of those kinds of atrocities and educate the general public about places and situations in which torture of animals or people is going on, that needs to be legally permitted. Although if the people who are filming are obviously in a position right there in the circumstance, to stop the torture of some animals or humans (instead of standing there and passively filiming it), then they have a responsibility to take action on the spot to stop it from happening and/or report it to the appropriate authorities. In some cases, obviously attempting to intervene might not be safe.

I hate the legal system. :'(

Have we failed these people? What neglect or atrocities have they witnessed or experienced to lead to this behavior? How devoid of love and compassion must a person be conditioned to cause such pain and terror to a living creature in the trust of their care?

I believe those who have capacity for love and compassion will support appropriate legislation to outlaw and prosecute those who produce, distribute and purchase these recorded acts of violence. As with all legislation, the devil is in the details. Any such proposed legislation must define a clear and precise distinction as to what is and isn’t considered to be illegal activity.

I'm sorry to let the facts of the case get in the way, but:

The reason the SCOTUS struck down the ban was that the language of the law was way too vague and would logically lead to all manner of videos potentially being banned. Your talking about the dangers of setting legal precedents here, and this could have potentially been a dangerous one in terms of censorship. It wasn't that the bill banned selling "crush" videos, but that it banned the sale of, say, hunting videos, which is a depiction of a legal act.

Something that jumps out to me, though: I thought you were a champion of free speech? Of free expression? I thought it was the big mean Bible-thug conservatives seeking to ban and censor language and expression, not the sensitive, open-minded, morally relative liberals like yourself?

I don't for a second condone torturing animals, nor can I understand anyone who wants to watch something like that. I just find it interesting that you're more interested in YOUR values being protected through censorship than a general protection of expression. That's the kind of thing I'd expect from Pat Robertson.

I strongly agree with the point you are making moby.

However, in Earthlings, there was a shot of a living (unwanted) dog being put into a rubbish truck on a city street, the type of rubbish truck that crushes it's contents. I imagine that being crushed inside a rubbish truck would be torture. The people who filmed it (presumabely the people who were filming for Earthlings), didn't try to stop that from happening. It could easily have been prevented. All it would have taken would have been for someone to say that they would take the dog, and it could then have been at least taken to some kind of animal shelter.

Maybe they got that footage from someone else, someone who had some other motive for filming that than wanting to stop preventable cruelty to animals. I don't know. What was your own feeling about that shot Moby, and the fact that whoever filmed it didn't appear to do what could have been done to stop that from happening? Did you ask the film makers where that particular piece of footage came from?

I agree with you entirely, and am thoroughly disgusted by this move.

And while I am certainly not a fan of hunting, I can't believe that there are people in the world who are comparing it to this. Hunting, from my understanding, is a legal activity (as much as I disagree with it) whereas torturing an animal isn't. :/

I can't help but wonder if some of those in favor of the ruling have a vested interest in this type of material being legal. :/
